ANDREW Demetriou has bunkered down ready for the war of his professional life. The urbane boss of the AFL thought he had his ducks in a row when he announced smugly that the Essendon anti-doping saga had been handled with great skill and aplomb back in August, just in time for his showpiece finals series.

The file was closed, Demetriou style, and the amazing world of the AFL - the one of ivory towers, big money and club ties - was all in one beautiful piece.
That was until two weeks ago when the wheels fell off the Andrew Demetriou machine. All hell has broken loose over the Essendon saga, and the AFL boss is now perched on the brink of disaster. All of that public relations glossing over, all of the deceit and the back room deals are coming home to roost for the once impregnable footy boss.
The great irony is that the undisputed golden boy of the AFL, James Hird, could be the very man to bring the whole thing crashing down. He walked away from his coaching job at Essendon with a big fat weekly pay packet. Yesterday came a claimed resolution. This time the spin is that Essendon will pay Hird what he's owed before the 2014 season starts. Regardless, Demetriou's seemingly perfect outcome was in tatters.
Meanwhile, in rugby league land, a newish chief with a plain name and a banking background opened a file last weekend and started going through it in a painstaking manner, at snail-like pace.

Dave Smith won't be rushed. This is infuriating for the media types like me waiting for an outcome to the Cronulla Sharks doping saga. It is even worse for those at the Sharks, eager to wipe the slate clean and get on with life after eight months of accusations, allegations and innuendo around the coach and player group.
Smith has sat back and watched with great interest the drama that has engulfed the AFL. He might be a novice in sports administration but he knows a crisis when he sees it. This, he says, will not be repeated at the National Rugby LeagueNRL.
Smith set up his own investigation into the Cronulla doping allegations. He told ASADA to go on their way and continue with an independent investigations. He did not interfere, like Demetriou did, in ASADA's work. He never said a single time that his model was the best (as did the AFL chief) and nor did he skite about the smooth handling of things at his end.
Smith did not make deals with the federal government to ensure players were given favourable treatment. He did visit the prime minister, however, when he realised the AFL had attempted to move the goal posts by seeking lighter penalties for their players. He insisted on a letter that spelt out very clearly the AFL would not get off as lightly as they had hoped.
Smith did not take part at any level in the NRL's investigation either. He left that to the integrity unit led by Jim Doyle and the new in house counsel, Nick Weeks.
The result is a report that has left no stone unturned and an ASADA investigation that is now uncovering more failings and findings because of its new powers. By next week, or the week after, those who oversaw the Sharks' alleged doping program will know their fate. It will be a measured, calculated and fair outcome.

The Sharks will not be in a position to complain like the Essendon Bombers did. They will not be allowed to go behind closed doors and broker secret deals. The evidence will be there for all to see and those closest to the doping will receive their just penalties.
Unless I'm a bad judge, that will include severe punishments for those who ran the doping program in 2011. The ASADA findings will deliver a double whammy for those officials.
The wait has been long, tedious and often gut-wrenching. The AFL's outcomes were swifter and much smoother. The result of their haste is now laid bare for the world to see - the Essendon doping saga is as far from resolution as it was in February when the federalgovernment announced we had a problem.
He may not have the communication skills of Demetriou or the fearless approach of David Gallop, but Smith is emerging as his own man. He will infuriate the media by being the tortoise to Demetriou's hare, but he will deliver an outcome that cannot be queried as anything but right and thorough.
The ultimate judgment for both men will come in coming months. Demetriou is long odds to survive his last big battle, while Smith, as unlikely and wide-eyed as he appeared at the beginning, might just be settling in for the long haul.

Dave, the investigation the AFL did into Essendon was about their conduct and handling of the matter in the interests of the game. It had NOTHING to do with drugs because that's not in their fricking jurisdiction!! That's ASADA's job and the AFL, like the NRL "claims", is leaving it to them!

NONE of the penalties levied by the AFL are due to drug use. They are levied for bringing the game into disrepute. Now I'll admit that the deal done in the penalties were a joke as Hird should have had his pay snipped. But that is NOTHING compared to the NRL!! Where is THEIR investigation into how much damage Cronulla has done to rugby league?? NOWHERE!!

If the AFL is a laughing stock then the NRL is an entire fricking comedy festival!!!

A FIERCE dispute between the AFL and Essendon over whether James Hird could be paid while suspended has meekly ended in farce, with the league endorsing a contrived arrangement in which the banned coach will receive his entire salary for next year before Christmas.

The extraordinary capitulation by the AFL, which came a day after league chief executive Andrew Demetriou threatened to withhold regular funding from Essendon until it stopped paying Hird, came as the club was preparing to take the league to court.

Having sworn to "go to my grave" with the knowledge that Essendon was not paying Hird, Mr Demetriou has now accepted the club will pay Hird his salary as stipulated by his three-year coaching contract. Under the terms agreed to last night, next year's salary will be paid this year.


In a joint statement, the AFL and Essendon said: "The AFL has accepted the Essendon Football Club's position that James will not be paid in 2014 and equally the AFL have accepted that the Essendon Football Club has the right to make payments to James Hird in the 2013 year as it sees fit."

Hird declined to comment.

The resolution came as World Anti-Doping Agency president John Fahey conceded his public declaration that Essendon faced inevitable doping charges was based on months-old "general discussions" and what he had read in newspapers.

Mr Fahey, who finishes as the head of the world's peak anti-doping body this month, has repeatedly said Essendon would have a case to answer once the Australian Sports Anti-Doping Agency completed its investigation into the club's 2012 supplements program.

Mr Fahey reiterated those comments in an interview with the Australian Financial Review published yesterday.

"I expect there will be several charges by ASADA," he said. "It's only a matter of when."

When contacted by The Weekend Australian, Mr Fahey admitted he had no specific knowledge on which to base his claims. He said he had not received any briefings from ASADA about developments in its investigation or the strength of the evidence gathered.

He also had not read ASADA's 400-page interim report, which formed the basis of the AFL's charges against Essendon, Hird and three other club officials.

"I have no knowledge," Mr Fahey said. "Nor do I want it. I have had some general discussions at different stages over the past year with different personnel, none of which have had any detail in it. I steadfastly refuse to accept detail.

"It has always been my understanding that when they finish their investigation there is a strong likelihood that action will be taken.

"I have learned nothing in recent weeks to suggest one way or another that is correct or incorrect. It has just been my understanding for a long time."

The AFL has had no information from ASADA suggesting doping charges are likely or imminent. The dramatic backdown in its dispute with Essendon and Hird will fuel speculation Mr Demetriou is losing the confidence of his fellow commissioners and may soon leave the job he has held for 10 years.

AFL bites off more than it can chew as deal challenges its rule

AT the start of the 2004 season, the Brisbane Lions were at the height of their powers.

Leigh Matthews's team had won the previous three AFL premierships. The club was profitable for one of the few times since its formation. Its mission was to win a fourth consecutive flag, something that had never been done in the history of the game. And it might have pulled it off, had it not picked a fight with the AFL.

Andrew Demetriou, having earned a reputation as a shrewd negotiator and troubleshooter as the AFL's manager of football operations, was entering his first season as chief executive of the AFL. One of the first problems that came across his new desk was a lingering sponsorship dispute with Brisbane.

It had entered into a contract giving Cadbury Schweppes soft-drink pourage rights at the Gabba for five years. The AFL didn't like the deal because it potentially infringed on Coca-Cola, one of the league's sponsors. When Brisbane refused to back down, Demetriou made it clear the AFL would hit it hard. And brother, did it hit hard.

First Brisbane was fined for flashing a Cadbury Schweppes ad across the Gabba scoreboard - about $700,000, with $300,000 suspended.

Then the AFL dispatched Ken Wood, one of its investigators, to examine Brisbane's books. Wood more than recouped his airfare. He discovered nine instances in which the club had lodged player contracts past the cut-off date. The club was found guilty of three counts per instance and fined $10,000 per count, $270,000 in all.

That year, Brisbane finished the regular season in second place on the AFL ladder. It won its first finals match and earned a preliminary final at home. However, Port Adelaide also earned a home preliminary final. A longstanding contract between the AFL and the Melbourne Cricket Club required one preliminary final to be played at the MCG every year. The AFL decided it would be Brisbane's.

In other seasons, for other games, the AFL and MCC might have shown a preparedness to bend the requirements of the contract. Not this time. Brisbane's pleas to the AFL fell on unsympathetic ears. To add inconvenience to injury, the AFL scheduled the Lions to play their preliminary final the night after Port Adelaide.

They would be required to travel twice in consecutive weeks and be given one day less than their opposition to prepare for the grand final, which they duly lost. Was this the ultimate payback for stocking the wrong kind of lemonade? "I have got no doubt," a former Brisbane official tells Inquirer. The AFL changed its agreement with the MCC the next season.

The Brisbane story is a cautionary tale for any club tempted to take on the AFL under Demetriou. It is a story that would not have been lost on the Essendon board members who spent yesterday deciding whether to follow Brisbane into the lion's den.

On its surface, the dispute between Essendon and the AFL was about whether the club could continue to pay James Hird while he is suspended from coaching. At its core, the dispute was about a football club calling out Demetriou and demanding the AFL stop its bullying ways.

That the dispute ended not in further pain meted out to an already wounded football club, but in humiliating capitulation by the AFL, represents a dramatic change of script. Other AFL clubs will be left wondering: is the reign of terror coming to an end?

When the modern AFL Commission was established 20 years ago as an independent body to govern the national competition in the interests of the game, it was hailed as a visionary reform. For too long, the development of the game had been stymied by the self-interest of the clubs.

Under a structure designed by businessman and sports administrator David Crawford, the AFL Commission and chief executive it appointed were invested with unchallenged powers to determine the make-up of the competition and the rules of football, and to protect the image of the game.

There is something faintly Orwellian about what the AFL has now become. Former Victorian premier Jeff Kennett, who saw how the game was run during seven seasons as president of the Hawthorn Football Club, calls the AFL a dictatorship, and Demetriou its "benevolent dictator".

In the 10 days since The Australian and Herald Sun began publishing revelations of the AFL's handling of the Essendon supplements scandal, there has been nothing benevolent about the AFL.
The AFL's dispute with Essendon, which until last night's peace deal appeared headed for a showdown before the AFL Commission and perhaps the Victorian Supreme Court, had its genesis in articles published in The Australian and Herald Sun last Wednesday, which exposed secret inducements offered to Hird to encourage him to accept a 12-month suspension from coaching.
The inducements were put to Hird on August 23, three days before the AFL Commission was due to meet and decide charges against Essendon, Hird and three other club officials. The charges flowed from an AFL and Australian Sports Anti-Doping Authority investigation into substances given to Essendon players throughout last year's season.

The inducements came after talks between Essendon president Paul Little and AFL chairman Mike Fitzpatrick, brokered by a mutual friend, Australian Sports Commission chairman John Wylie. Under a proposed settlement package, Hird would remain on the Essendon payroll and in the AFL Hall of Fame. He would be given an "outstanding career development opportunity" during his year of suspension, with the idea of an MBA at Oxford floated by Wylie, a Rhodes scholar and trustee of the Rhodes Trust.

In return, Hird would immediately abandon Supreme Court action he had initiated against the AFL two days earlier. Demetriou was not party to the negotiations.

The morning the story was published, Demetriou denied its central claim: that the AFL was involved in inducements offered to Hird. He homed in on what he believed was a weak link in the reports: the claim that Hird was still getting his estimated $1 million salary from Essendon.

"The sanction to James Hird is 12 months' suspension, is suspension without pay," Demetriou told Melbourne radio 3AW's Neil Mitchell. "So it is incorrect that he is being paid by the Essendon Football Club. He is not allowed to be paid. I want to make that very clear. I can categorically tell you that part of the sanction from the AFL is that he is suspended without pay from the Essendon Football Club ... It is one thing I will go to my grave on.

"I know 100 per cent the AFL is not paying and I know that Essendon is not paying."

Before Demetriou and media adviser James Tonkin had entered the lift outside the Fairfax radio studios, senior AFL officials knew they had a problem. Hird was being paid by Essendon and there was nothing in the sanctions agreed to between Essendon and the AFL, and the AFL and Hird, that prevented the club from paying its suspended coach.

The AFL Commission believed Hird would not be paid when it endorsed the sanctions on August 27 but this very point had been discussed and settled by lawyers acting for Hird and Essendon. Under the final sanctions agreed to and written out after 12 previous drafts, Hird could be paid. It is unclear why this was not communicated to the commission.

During the past week, negotiations between Essendon and AFL officials further exposed the cynical nature of Australia's most successful national football competition. The AFL's preferred solution, one flatly rejected by Hird, was for Essendon to pay its suspended coach off the books.

Another contrived compromise, floated earlier this week and accepted by both parties last night, is for Hird to be paid his entire 2014 salary this year, meaning no payments will fall into his season of suspension. Essendon announced last night that the club and the AFL had "accepted this matter is concluded to both their satisfaction". Hird is unlikely to object. Who would object to the idea of getting a year's salary in advance?

The turning point in the dispute came three days ago, when Tania Hird decided she'd had enough. People who know James and Tania Hird well say they are a formidable combination. During the two days at AFL House on August 26 and 27, when AFL charges against Essendon and its officials for bringing the game into disrepute were settled over hours of intense negotiation, Tania was in the thick of it. Hird's solicitor Steve Amendola says it was Tania, a lawyer by training, who wrote out in longhand a draft of Hird's new coaching contract moments before he accepted his 12-month ban.

Early on Wednesday morning, she was collecting the papers from her drive when, like so many mornings before, a reporter approached her for comment. "Is your husband being paid by Essendon?" the reporter asked. The question found its mark.

"Of course he is being paid, that was the deal," Tania Hird replied. "Andrew Demetriou knew it, the AFL knew it. We wouldn't have taken a sanction without pay, we would have taken the AFL to the Supreme Court and they knew that, Demetriou knew that.

"You know, in my opinion, it's time for the AFL to stop threatening my husband, it's time for them to stop threatening the club and it's time for them to stop distorting the truth."

The AFL responded with a fresh threat to Essendon: until the club stopped paying Hird, it would withhold funding. According to a letter to the club from AFL general counsel Andrew Dillon, it was the AFL's "clear intention" that Hird not be paid while suspended: "If the club continues not to comply with the terms of the suspensions, the matter will be referred to the meeting of the AFL Commission in Melbourne next week."

Little was in Hong Kong when the AFL issued its ultimatum. He flew home overnight, met his board yesterday and by late afternoon had finalised a deal acceptable to the AFL.

The AFL will say it got what it wanted: for Hird not to be paid throughout a season he is missing as punishment for his role in the supplements saga. It knows no one will buy it. For the first time in a long time, Demetriou started a fight he couldn't win.
