ELIZABETH JACKSON: The Australian Football League is once again having to defend itself over its handling of rape allegations against its players.
An Australian woman has accused former AFL player, Adam Heuskes, of raping her in a London hotel room, while four of his then Brisbane Lions teammates watched on. The woman claims the incident happened in October 1999, when the club was on an end of season trip.
Ten months later, in an unrelated incident, Heuskes faced a charge of raping another woman outside an Adelaide nightclub.
The claims are made in tonight's edition of Four Corners on ABC television.
Heuskes now plays for a suburban Adelaide football club, and has refused to comment, as Alison Caldwell reports.
ALISON CALDWELL: The woman referred to as "Sarah" claims that on October the 6th, 1999, she caught up with a Brisbane Lions team member in a London pub. A friend of her boyfriend since high school, his team was in town on an end of season football trip.
She claims that night at the pub she had to resist the advances of another Brisbane player, Adam Heuskes. With her home some two hours away, her friend invited her to stay in his room that night.
Sarah says she fell asleep, but three hours later that night, she claims she was raped by player while at least four of his Brisbane Lions teammates watched on.
Speaking to Four Corners, "Sarah" names Adam Heuskes as the player who raped her.
SARAH: I know it was Adam because I met him in the pub earlier when I was completely sober, and I recognised his face when I was lying on my back and he was on top of me. And I did recognise his voice and I know it was him who turned me over and put me on my hands and knees.
ALISON CALDWELL: Tonight's Four Corners program raises serious questions about football rape, hush money and how cases never get to see a jury.
"Sarah" says she reported the attack two weeks later, but by the time Scotland Yard detectives began their investigations, the team was back in Australia. They all disputed the rape claim and no charges were laid.
In July 2000, Adam Heuskes quit the Lions, citing boredom. A fortnight later, he was accused of raping another woman, this time in Adelaide, outside a nightclub.
Along with Port Adelaide player, Peter Borgoyne, Heuskes was charged with sexual assault, but six weeks later the South Australian DPP, Paul Rofe, withdrew the charges. He maintains that there was no reasonable prospect of a conviction on any criminal charges.
But the woman's cousins refused to accept the DPP's decision. Speaking to Four Corners, they claim they went to see the DPP in person at the time.
WOMAN'S COUSIN: I strongly remember Paul Rofe saying that he believes 100 per cent that she was raped.
The rape was premeditated for the other two boys to be following, but legally he couldn't take it any further because it boiled down to a case of what he said, she said. So there were no witnesses are to the rape.
ALISON CALDWELL: Paul Rofe told Four Corners he considers his conversations with the victim and her family confidential.
In March this year, Adam Heuskes was named, along with Peter Borgoyne and Michael O'Loughlin, as the three players who contributed to a reported $200,000 payment to the Adelaide woman as part of a confidentiality agreement.
Sydney Swans star Michael O'Loughlin was never charged or interviewed by police. The three players deny the allegation that she was raped or sexually assaulted.
Peter Borgoyne still plays for Port Adelaide. The club reportedly fined him $5,000.
The club referred Four Corners to AFL chief Andrew Demetriou. He's speaking to reporter Ticky Fullerton.
ANDREW DEMETRIOU: Well, you have to direct those questions to the Port Adelaide Football Club…
TICKY FULLERTON: But they directed to ask you.
ANDREW DEMETRIOU: Yeah, but again, you've mentioned a word there which is alleged assault. Why Port Adelaide chose to fine Peter Burgoyne for being out at night, being in the appropriate place is a matter between Port Adelaide and the player. Again, I'm not privy to why they fined them, other than I know that there was a $5,000 fine.
TICKY FULLERTON: Could it have been because he was associating with Adam Heuskes?
ANDREW DEMETRIOU: I don't know. Again, I'm not privy to that information.
ALISON CALDWELL: At the time Adam Heuskes wasn't with a club, but he now plays for the state club, North Adelaide.
TICKY FULLERTON: Shouldn't the AFL have looked into this?
ANDREW DEMETRIOU: No, I think if he's an individual, anyone who's an individual in society, we have got the law.
ALISON CALDWELL: Four Corners made several approaches to Adam Heuskes. He hasn't responded.
