Now that Tasmania is joining the AFL there is a lot of discussion about their name and how they cant be called the Tasmanian devils, Tazzy Devils or the Taz Devils without the permission of Disney, because they own the copyright.
This is rubbish, Disney own the copyright to the character, nothing more. Not Tasmania, Tazzy, Taz or devil, they apply to real objects, Disney did not make up any of those words (so they are not their creation) and all have been in common use well before Disney was created.
So if the AFL wanted to use the caricature of Disneys “Taz” in a logo there maybe be an issue.
But seeng the Disney cartoon looks nothing like a Tasmanian I doubt that would happen.
But there is No other issue, and the AFL registered the relevant names ages ago.
Its Warner Brothers not Disney and he consensus seems to be that WB have some commercial rights - specifically merchandising - that would make it difficult to monetise the name Tassie Devils or similar without some negotiation.
Yes, my bad, WB not disney.
WB only has rights to the Character they created, not the name, which they did not create and has been in public usage since at least the early 1850’s.
If the AFL used a likeness of the WB character WB can argue there is an infringement on their creation.
The “consensus” are not listening to the copyright lawyers, who are not getting much press at the moment, but most if not all are saying only the logo could be an issue.
You Can’t copyright “african Lion” “the grand canyon” “siberian tiger” or anything else that you did not create, and you can’t copyright “tasmanian devil”
And the AFL is using now for the NAB team and has used it for the VFL with merchandise and logos…
And in 1986 this

Only the character is the problem…maybe “Taz” and “tazzy”…maybe but not “tas” or “tasmania” nor devil.
A bit of much ado about nothing.
There are lies, damn lies and then there are ratings.
